Required Notices - July 29, 2011
As required by law, the following items will be mailed to Participants, Beneficiaries, Employers, AFM and AFM Locals on July 29, 2011:
- Cover Letter including Rehabilitation Plan changes.
- Notice of Critical Status for Plan Year Ending March 31, 2012 - This notice advises you that, as was the case last year, the Plan was certified in critical status. It describes the legal reason for that certification and discusses the implications of it. Unlike last year, there are no additional changes being made to benefits as a result of this certification.
- Annual Funding Notice for Plan Year Ending March 31, 2011 - All defined benefit plans like the Plan are required to provide you with this annual notice, regardless of their funded status. Please be aware that parts of this notice reflect the finances of the Plan as of April 1, 2010, rather than March 31, 2011.
- Notice to Participants and Beneficiaries Regarding Funding Relief - This document advises you that the Plan's Board of Trustees elected to take advantage of special rules that provide a longer period for the Plan to take into account the unprecedented investment losses in the Plan year ending March 31, 2009. The notice also discusses the implications of that election.

REHABILITATION PLAN- The Pension Protection Act of 2006 requires the funding "zone status" for defined benefit multiemployer plans including the American Federation of Musicians and Employers' Pension Fund (the "Plan") to be certified each year by the plan's actuary. On April 15, 2010 the actuary for the Plan certified the Plan to be in "critical status" (also known as the "red zone") for the Plan year beginning April 1, 2010. This notice can be viewed at Notice of Critical Status.pdf. The significance of entering critical status is that the Plan's Board of Trustees (the "Board") is required by law to adopt a "rehabilitation plan" designed to improve the Plan's financial health and to allow it to emerge from critical status.
On April 15, 2010 the Board adopted a rehabilitation plan (the "Rehabilitation Plan") consistent with this requirement. You can review the "Rehabilitation Plan" by going to REHABplan.pdf. Common questions and answers related to the "Rehabilitation Plan" are available to review by going to Q-A.pdf.
On May 18, 2011 the Board of Trustees approved updates to the "Rehabilitation Plan". These updates can be viewed at REHABplanupdate5-18-11.pdf.
Important Notice of Benefit Changes EFFECTIVE June 1, 2010 - This notice describes the reductions in benefits that are part of the Rehabilitation Plan and provides examples of their potential impact. The notice also describes two benefit changes that are not part of the Rehabilitation Plan: changes to one of the re-retirement benefit calculation methods and freezing the Internal Revenue Service ("IRS") annual compensation and annual benefit limitations at their current levels.
