Required Notices - July 29, 2016
As required by law, the following items will be mailed to Participants, Beneficiaries, Employers, AFM and AFM Locals on July 29, 2016:

- Notice of Critical Status for Plan Year Ending March 31, 2017 - The Plan was certified in critical status. It describes the legal reason for that certification and discusses the implications of it.
Annual Funding Notice for Plan Year Ending March 31, 2016 - All defined benefit plans (including the Plan) are required to provide you with this annual notice, regardless of their funded status. Please be aware that parts of this notice reflect the finances of the Plan as of April 1, 2015 rather than March 31, 2016.
Multiemployer Pension Reform Amendment of 2014 (MEPRA)
Congress recently passed new pension legislation, called the Multiemployer Pension Reform Amendment of 2014 (MEPRA). Much of the legislation includes technical modifications to the existing law (the Pension Protection Act). However, a new provision allows "Critical and Declining " plans only to suspend certain benefits already earned by participants, including those receiving pensions. You should know that the AFM-Employers’ Pension Fund is not considered to be a “Critical and Declining” plan as it is projected to remain solvent throughout the entire 33-year period for which the Fund’s actuaries provide projections.
Notice to Participants and Beneficiaries Regarding Funding Relief - This document advises you that the Plan's Board of Trustees elected to take advantage of special rules that provide a longer period for the Plan to take into account the unprecedented investment losses in the Plan year ending March 31, 2009. The notice also discusses the implications of that election.
